Terms of Service

1. “Platform”: Refers to Community VC, including its website, mobile applications, and any related services.
2. “User”: Any individual or entity accessing or using the Platform.
3. “Founder”: Any individual or entity that creates an account to seek support, engage talent, or raise capital.
4. “Talent”: Any individual or entity offering skills, services, or expertise on the Platform.
5. “Investor”: Any individual or entity providing or seeking information about investment opportunities.
6. “Content”: Any information, text, graphics, or other materials uploaded, downloaded, or appearing on the Platform.

By using the Platform, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.

We may modify these Terms of Service at any time. Any changes will be effective immediately upon posting. Your continued use of the Platform after the changes have been posted constitutes your acceptance of the revised terms.

1. You must be at least 18 years old to use the Platform.
2. By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement.

1. Account Creation: To access certain features of the Platform, you must create an account. You agree to provide accurate and complete information during the registration process.
2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Account Termination: We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we believe violates these Terms of Service.

1. Permitted Uses: The Platform is intended for founders seeking to engage talent, raise capital, and achieve their missions, as well as for talent and investors offering support and resources.
2. Prohibited Uses: You may not use the Platform for any unlawful purpose or in a way that infringes on the rights of others. Prohibited activities include, but are not limited to:
   • Posting false or misleading information.
   • Harassing, threatening, or defaming others.
   • Engaging in fraudulent activities.
   • Violating intellectual property rights.
   • Spamming or distributing unsolicited messages.

1. Responsibility for Content: You are solely responsible for the content you post on the Platform. By posting content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Platform.
2. Content Standards: Content must not be illegal, offensive, or harmful. We reserve the right to remove or modify any content that violates these standards or our policies.

1. Ownership: The Platform and its original content, features, and functionality are owned by [Platform Name] and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
2. License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform for its intended purposes.

You agree not to disclose any confidential information obtained through the Platform without the express consent of the disclosing party.

The Community VC Referral Program makes it easy to share Community VC with your network and and be rewarded at the same time. For every business that you refer who become a paying Community VC customer, you will be eligible for a $100 voucher. In addition any referred businesses are also eligible for one month free use of Community VC.

To the fullest extent permitted by law, Community VC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

1. Your use or inability to use the Platform.
2. Any unauthorised access to or use of our servers and/or any personal information stored therein.
3. Any interruption or cessation of transmission to or from the Platform.

You agree to indemnify and hold harmless Community VC, its affiliates, and their respective officers, directors, employees, agents, and representatives from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms of Service.

These Terms of Service shall be governed by and construed in accordance with the laws of Queensland, Australia without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms of Service or the use of the Platform shall be resolved through binding arbitration in Queensland, Australia, in accordance with the rules of the Queensland, Australia.

1. Severability: If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will remain in full force and effect.
2. Entire Agreement: These Terms of Service constitute the entire agreement between you and Community VC regarding the use of the Platform.
3. Waiver: No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and [Platform Name]’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

The following Terms and Conditions apply to the Program –

1. You must register all referrals via the Referral Program form prior to the purchase being made in order to be eligible for the reward. You acknowledge and agree that we may disclose your name to your referees as the referrer.
2. Your friends or colleagues who have been referred will receive one month free use of Community VC when they register for a paid plan.
3. As the referrer, you will receive a $100 gift voucher for each new customer you have referred who has registered and been a paying customer for 30 days. A “new customer” must be a person or entity that is unrelated to the referrer.
4. Referral Program rewards do not count for referrals that may have been made prior to the launch of the Program.
5. Referral accounts that are cancelled by Community VC for any reason (non-compliance with Community VC’s Customer Terms will not be included in the Program.
6. Community VC reserves the right to terminate a user’s involvement in the Program if Community VC suspects that there is some abuse of the Program.
7. Community VC may amend these terms and conditions from time to time and revised terms and conditions shall become effective immediately upon publishing.
8. Community VC reserves the right to amend, suspend or cancel the Program at any time.
9. You agree to comply with any applicable laws and the Community VC Terms & Conditions. This Program is void where prohibited by law.
